This is the third of the most recent of three articles on the UN Security Council Vote on Israel’s international law violating occupation and Israel’s Fourth Geneva Convention violation.

Hanna Issa, an international law professor at Birzeit University, has declared that Israel’s demolition of Palestinian houses violates the provisions of Article 33 of the Fourth Geneva Convention of 1949, which states, “No protected person may be punished for an offense he or she has not personally committed.” These acts also violate the provisions of Article 53 of the same convention, which prohibits the destruction of fixed or movable property, and Article 17 of the Universal Declaration of Human Rights of 1948, which states, “No one shall be arbitrarily deprived of his property.” He said Israel also is flouting a UN Security Council Resolution from 2004.

Furthermore the United Nations Resolution 242 adopted unanimously on November 22, 1967 stipulated the following principles which Israel has continually violated :

(i) Withdrawal of Israeli armed forces from territories occupied in the recent conflict;

(ii) Termination of all claims or states of belligerency and respect for and acknowledgment of the sovereignty, territorial integrity and political independence of every State in the area and their right to live in peace within secure and recognized boundaries free from threats or acts of force.

Furthermore, since Israel’s invasion during the war of 1967, which Israel and not the Arabs provoked, of what was left of Palestine, i.e. 25% of the original Palestine, which added to what happened after the 1948 violent take over of “mandatory” Palestine, i.e. British invaded and occupied Palestine, by Western Jewish Zionists when two terrorist and British armed organizations, namely Irgun led by Menachen Begin and Stern Gang, led by Yitzhak Shamir, both of who eventually became Prime Ministers of that nation-state entity which essentially was the embodiment of he attempted nationalization of the Judaic religion, something which, despite propaganda and historical adulteration to the contrary, never was universally approved by all Jews,   countless United Nations resolutions, most particularly Resolution 242 calling for Israel to return to pre-1967 borders were brazenly violated and settlement construction in occupied territory were relentlessly and illegally pursued while the dishonestly and perversely in a Kafkaesque fashion,  misleadeship of Israel framed the Palestinians as the saboteurs of imaginary peace offers by Israel which no responsible Palestinian leader could accept.

This led to the massive forced exodus of millions of the autochthonous Palestinians from what was their homeland for centuries, which were imposed by the Zionist misleadership of Israel on the false claims that (a) the Nazi crimes against the humanity of Jews and others required this take over at the expense of the Palestinians, and (b) then notion that biblical history, most particularly Deuteronomy 6, 10-12 of the Hebrew bible,  promising “God’s chosen people” the “promised land” could be used as a lien on the land of the natives of Palestine who could be punished severely by expulsions, collective punishment house demolitions, and outright massacres such as the Deir Yassim massacre in 1954, the Ariel Sharon Sabra and Shatila massacre of Palestinian refugees in Lebanon,  and most recently the Netanyahu power structure massacre in Gaza in the summer of September of 2014.

For an in-depth, highly scholarly account of the barbaric suffering and humiliation the Palestine people had to endure since 1948, and then from 1967 on when the U.S. started to develop interests in the Middle East which led it to irrationally and unconditionally support Israel, generating incalculable damage to its own best interests in the long run, as well as to the interests of decent, rational, noble Jews living in Israel, and to Judaism globally, one of the best accounts is that of the highly acclaimed Jewish scholarly historian Illan Pappe in his book “The Ethnic Cleansing of Palestine”.

So, to cut to the chase, and fast forward to the last 3 days,  a quantum leap forward in the direction of bringing justice to Palestinians as well as potentially peace and security for all Jews in Palestine, has been inaugurated by the heroic and highly principled stand, President Obama took, to for the fist time in history not veto a United Nation Security Council Resolution demanding the immediate cessation of Israel’s international law violating occupation and of its barbaric oppression the natives of Palestine.

For this President Barak Obama, notwithstanding the disappointments due to the shortcomings of the Affordable Care Act, due to his use of drones in several countries which have resulted in the deaths of thousands of innocent unarmed civilians, and his failure in not having closed the U.S. concentration camp where innocents were tortured in U.S. occupied territory in Cuba,  he still deserves tremendous credit and even a second Nobel Peace Prize for his support of such a crucial and fabulous  United Nations Security Council Resolution which once for all was approved without ANY OPPOSITION.

This will increase tremendously the already existing universal support for severe economical sanction on Israel, if it ignores this resolution, regardless of what Donald Trump and Benjamin Netanyahu may say, as they are now largely irrelevant, since a UN Resolution is not reversible, just as the Iran nuclear agreement between Iran the P5+1 is irreversible, and just as President Obama’s historical opening to Cuba is irreversible, an opening for which the General Assembly of the UN called year after year for decades, yet only the United States and Israel vetoed.

This vote has been a literal gift to humanity, since it reopens the probability of a Two State solution which the Zionist right-wing extremists had sabotaged for about 5 decades or, if the exclusivist hegemonic Zionist right-wing extremist led by the Netanyahu power structure and supported by Donald Trump if he has not yet been impeached, ignore it,  then the West Bank will be invaded by Israel and in effect all of Palestine will be occupied and annexed, and that in turn would be the end of the existence of Israel, since on the basis of demography, Israel will be a full-fledged Apartheid state of the kind that South Africa was prior to its collapse, which means that such a state would be untenable since the world will not recognize the resurgence of a so-called state where undemocratically a minority of, in this case, exclusivists Zionist supremacist right-wing Jews, rule a majority of Christian, Moslem, and secular inhabitants.

It is important to note how Netanyahu and Trump disgraced themselves more than they already have a track record of doing so, particularly as regards to this vital and historical issue, by Netanyahu first urging Trump to press Obama to do what the world, including a majority now of non-Zionist Jews oppose, namely continuing the status quo ad nauseam and ad infinitum which maintenance of what constitutes a major danger for Jews, Palestinians, and the rest of the world as it may very well, if left festering as it has, involve the major world powers in military confrontation.

The prestigious American Council for Judaism, is one of the institutions which are highly commendable example of highly rational and humanist scholarly reform Jews who correctly do not even recognized the historical and legal legitimacy if the nationalization of the Judaic religions, something which the German Jewish  parents of this writer never did as well.

This does not mean by any stretch of the imagination that the millions of honest and courageous Jews of this perspective and philosophy would endorse any kind of violence against those inhabiting Israel now, but certainly there is a valid point in considering the alternative One State solution option, which by the way, is expoused by Miko Peled, a former military officer in Israel’s armed forces and son of General Matti Peled, who wrote the book “The General’s Son : Journey of An Israeli in Palestine” , and who, as this writer does, envisages the integration of Israel as a kind of Switzerland “canton” into a broader democratic Palestinian federation which, of course in addition to  being  by virtue of its present demographics and by virtue of it having afford the  “right of return” of mostly the offspring of the Palestinians forced violently into refugee camps, will be democracy with one vote for one man/woman and hence the Jews in Palestine will not have majority rule thereby and exclusivist rights,  particularly since the ludicrous notion based on biblical grounds that anyone in the world today who has a Jewish mother has some kind of a “right to return” to the land violently occupied by European, Russian, and American Jews is an absurd notion.

Once Netanyahu failed in pressing Trump and Trump failed in pressing  President Obama, Trump ridiculously tried to press the misleader of Egypt, General Al Sissi who carried out a coup against the only democratically elected president Egypt ever had, namely President Morzi, and while this had the minor effect to getting the Egypt’s UN ambassador to withdraw the sponsorship of the resolution at the UN, hours later New Zealand, Venezuela, Malaysia, and Senegal, which are presently members of the temporary outer circle of the UN Security Council, and they as expected resubmitted said resolution which then was not only approved, but for the first time in decades to the background sound of tremendous applause.   The resolution was as well vote on by Egypt after all.

This victory for the truthful historical narrative  is a game change which could not have come at a better time and it adds to the joy of the festivities of the season by Jews, Christians, Moslems, and Seculars who have as common denominator a truly humanist dimension and therefore yearn for nothing more than peace and justice for all, so that healing, reform, reconstruction can lead to egalitarian prosperity and so that the next UN Security Council resolution can focus on the elimination of ALL of the world’s NUCLEAR WEAPONS arsenals, most particularly that of the clandestinely acquired arsenal of nuclear WMD by Israel which refused to sign on to the Nuclear Non-Proliferation Treaty and thus documentably and ironically proliferated the technology for nuclear energy weaponization to the white supremacist regime of Apartheid South Africa during the mid 80’s.

One of several sources which documented this scandal which the mainstream media chose to not report on, was the book by a Jewish author whose parents had fled from Nazi occupied Austria to South Africa only to have to leave South Africa as well, and his name is Sasha Polakow-Suransky and his book title is “ The Unspoken Alliance : Israel’s Secret Relationship with Apartheid South Africa “
